If your child was observed trying to get out of his seat, if there were numerous complaints from other passengers (who have a right to a peaceful flight) that your child was being disruptive, then yes, you can be removed from the flight. It has happened many times on many airlines. The passengers don't win those fights in court either. Since this happened after the flight was in the air, it might be out of the jurisdiction of small claims. After all, which court would you file in? What state was the aircraft over at the time?
And for gods sake, with children that young why in the world were you making them fly so late at night?
