I think this customer should complain to the DOT and the Office of the State Attorney General in Florida. The reality is that he was misinformed by the airline itself and the website is not clear. The charges page for the baggage implies that you can take additional bags for a fee. It is an unfair term and condition to expect a customer to read every single item listed under the Help page on the website, and courts have repeatedly found in favour of consumers where this has been tested. For the airline to expect a customer to read through the entire help page, to find out that there was an exception for flights to Lima, Peru is ridiculous. The airline should either have put a note on the baggage page with a link to specific restrictions for specific destinations, or put a note on the confirmation sent to the customer, as Spirit knew that Lima, Peru had such a restriction. How the customer was supposed to know is anyone's guess. You can call the Florida Attorney General's office on (850) 414-3300. There is a link to the DOT on the Quick Links tab on this website.

CHECK FIRST to make sure that your confirmation didn't have any note advising you to check baggage rules for Lima, Peru. If it did, you will be out of luck. However, if you can demonstrate that Spirit expect customers to read the entire Help section to find out specific information, that is unreasonable and I think you may prevail.
