A320 you are wrong to state if it is in the website, then Spirit are in the clear. It has been repeatedly found that burying specific terms and conditions in the website is an unfair term and condition.
It is unreasonable of Spirit to expect a customer to search in obscure pages. They have two clear opportunities to disclose this material fact. First, ensure either the confirmation email or the actual booking page when selecting Peru as a destination link to, or contain details of the restrictions or second, place an * against the baggage charges and make clear that restrictions apply to certain destinations.
Anything less than this is unreasonable and the courts have supported this... for a contract to be valid there must be a meeting of minds of both parties...Spirit's approach to this problem militates against this.
