Confiscation happens without proof
They tried to sue before and they lost. Its a policy and all AA can do is confiscate tickets and close accounts. The judge said it was just a matter of Mr. X flying in Mr. Y's seats and no damage was done to the airlines.
It doesn't help AA to enforce these rules. Or to even have them. If they want to enforce this rule then they should just shut down their program but they won't because they make a lot of money which should cause they to end this stupid rule that only hurts their program.
First they are making money off the program. Second they will lose a lot of customers / members who will switch to other programs. Third they have to pay those security people to enforce the rules who do not help their program but hurt it. Fourth people will opt to fly on another carrier when able to do so because of the way they enforced their rules waiting to get to the airport to black mail them.
Also its not like people selling their miles will hurt AA because they only allot a few seats for mileage redemption.
I still think if the members got together for a class action the judge would rule on their side because no one likes what they are doing.
Another thing is this only started happening (confiscating in mass) when AA started to sell their airline to US Air. Of course they don't care about their airline because they are getting out of the business.
American need to be taken to court so they have to prove that these members were selling their miles. They have no proof and never present it when they close the members accounts. They just accuse the members without any proof.
