The standard in courts is generally the "reasonable person" comparison. Take any soccer mom out there and see if she can be fooled/confused by it. Definitely the case here, and Delta knows it.
And the final key is that they are pissing off customers. Delta just came out of bankruptcy not long ago. Stupidity like theirs over this supposed "guarantee" is exactly what will put them right back there.
Hey...I still have lots of airline choices. Delta is rarely the least expensive. This is an easy choice to stop giving them money.
