Default Reinstatement of Miles Fraud

Below is my email to the US Airways Complaint Dept:

To whom it may concern,

I am writing to lodge a formal complaint regarding an offer made by US Airways that was not fulfilled. I have now spoken to 5 US Airways specialist to address the reinstatement of 25,953 miles. When I visited the US Airways website earlier this year, I received the following message (see attached screen capture below):

Miles in your account have been forfeited due to inactivity. To reinstate these miles, you can buy a ticket and fly at least one flight on US Airways by 10/30/2011. You can also reinstate these miles with one of our credit or debit cards or pay a reinstatement fee.

According to the explicit instructions in this message, in order to reinstate my miles, I needed to:
1) buy a ticket and
2) fly at least one flight on US Airways by 10/30/2011

I fulfilled both of these conditions and never received my reinstatement. There was no further requirement regarding this offer; clicking on the link to "buy" the ticket takes the user directly to the "Book Travel" webpage. On Aug 6, 2011, I flew on US Airways flight 430 fulfilling the requirements. I spoke to multiple agents, most recently today (Aug 29, 2011), and they said that in order to get those miles reinstated I needed to apply the new miles to my US Airways dividend account. This was not stipulated anywhere as part of the reinstatement, and if I had known that I would have used my miles towards the US Airways dividend. The coordinating supervisor I spoke with on the phone today, Kathy (DJ), was not only unhelpful but condescending in her tone as she communicated that these policies were obvious and did not need to be written explicitly. As a frequent traveler, I am appalled by the disrespectful nature of your supervisors.

I am extremely upset about this issue. I believe that legally this constitutes an offer and acceptance which you must honor, otherwise your actions constitute a breach of contract and may even be considered fraudulent, especially as your own representative acknowledged that there were no other written requirements on the website. I expect a full reinstatement of my mileage or I will proceed with legal action and a complaint to the Better Business Bureau as well as the Department of Transportation. I will escalate this issue further until this has been satisfactorily addressed.

Have you tried simply submitting a missing miles request on their website?

For retroactive mileage credit for a US Airways flight, log in to your profile and click on 'request missing miles.'

Once they research the flight info submitted the miles should post to your accont and you can then request the reinstatement again.

I think it's time to accept that most airlines have no respect for their passengers whatsoever, and their only motivation is profit!

Taking away thing's that have already been earned and awarded is theft. I have just been stripped of my 74,331 miles earned and told by a US Airway representative that to reinstate them I will need to pay $250.00.

Last year when visiting my 95 year old mother in England, she fell and broke her hip which meant extending my trip by a few weeks. I was charge double the extortion rate to do this, as the person I spoke to said there were two flights involved (layover in Charlotte).

Eventually, US Airways agreed that I was overcharged, but also said I could only be compensated with an invisable voucher against any future trip, but I could not use it on line where the best prices are found. It also had a shelf life of just 12 months. They also said they could not refund the meney!

I guess the airlines have now joined the ranks with the oil companies and banks in scamming us at every possible opportunity, just because they can get away with it and the law doesn't protect us. My advice is, forget the air mile scam and just find the best price for your trip. Above all, boycot US Airways who are among the leaders in rippng us all off. It's the only way to make them aware that what goes around comes around.
