It all really depends on the amount of duty time the captain had before the flight. If his SCHEDULED duty time exceeded FAA minimums, the flight was illegal. But if the actual duty time went over his legal scheduled duty time, it should not have been an issue. It's all about what is printed on the paper, not what is actually flown. You could spend many more hours flying each day than the scheduled time and its legal.
