Angry Kenya Airways cancelled flight 29 March 2009

I have been chasing Kenya Airways for compensation for a flight from London to Nairobi on 29 March 2009 that was cancelled as the plane from Nairobi never arrived to London.
Since then i have been constantly been fighting for compensation with no luck and it is October 2013, four and half years after the date and still Kenya Airways is refusing to pay the full compensation that i think i am entitled to despite being advised by the Civil Aviation Authority of UK that they needed to pay the compensation back in 2010.
I am asking for 1,200 euros only due to the time that has lapsed and also for my time and effort over the last four and half years chasing for it.
They said that they cannot pay the 1,200 euros but offered 700 euros and i said okay i will accept that but in addition i want a free return first class ticket as well.
They never said no and now i have still not received the 700 euros that they agreed to pay in September and also they are now saying that they never agreed to give the free ticket.
I have therefore advised them that they either pay the 1,200 Euros or the 700 Euros and free first class return ticket but they are now threatening legal action.

I checked on line at 1.00 a.m on Sunday 29 March 2009 and choose my seat and printed a boarding card and then arrived at Terminal 4 Heathrow Airport at 7.30 a.m and the check in counters were closed and when enquired, was
given a letter that the flight KQ 0103 had been cancelled due to the inbound
flight KQ 0102 had a prolonged technical defect and did not arrive. Was asked to make my way to the ticket sales desk and there was already about 60 people in the queue waiting for alternative flight connections. Waited in the queue till about midday and then was asked to call the telephone numbers 020 8759 7368/ 7366/ 7309 on the letter by Silvia the ground staff . The
telephone numbers kept on ringing and then asked Silvia and she advised for us to call the reservations on 020 8283 1818 and they refused to accept liability for putting me on an alternative flight and also refused to give any compensation as they said that it was not their responsibility even though the flight had been cancelled due to them. After some minutes of arguing asked Silvia to talk to them and then they managed to book me on a British Airways BA 065 Flight for Monday 30 March 2009 at 10.20 a.m and then i left Terminal 4 at 1.00 p.m. and checked into Park Inn Hotel as they bus from there
would take me to Terminal 5 at 7 a.m. AT about 5 p.m. on Sunday 29 March called the reservations again and asked for compensation and Varsha said that we will not get any but then said that there was British Airways Flight BA 063 that evening at 9.15 p.m. from Heathrow to Entebbe and then Kenya Airways to Nairobi. As i had only six days in Nairobi as i was flying back on 5

Entebbe to Nairobi but no ticket had been issued and they were trying to contact Heathrow and at the same time my wife was on the telephone to Kenya Airways from here in London as i had already lost a day of my annual leave by just being at the airports. The flight was fortunately delayed and i mentioned to the Kenya Airways Staff that they better make sure that i get on that flight and i had been messed about by them since Yesterday
morning due to the flight from Heathrow being cancelled and gave them all the
paperwork that i had. Then 5 mins before the Flight was to depart they received the confirmation from Heathrow and i was given a manual boarding pass and then allowed to board the flight which took off at 11.00 a.m and arrived in Nairobi at 11.50 a.m. I therefore would like you to compensate me for my loss of leave days and also for wasting my time and also as i was
not given alternative flights till after 6 hours. I seek compensation of £1000 for the refund of my flight and loss of earnings and also for not attending the wedding ceremonies on time.

File in small claims. When you win, (you will win, perhaps not the free first class ticket) but you are entitled to a refund and the compo due from EU Reg 261/04. I suggest you will get around an extra €600 under this reg, unless they could argue 'extraordinary circumstances'.

If they fail to pay the claim, you can then have the satisfaction of getting bailiffs to seize their plane. It has been done... they will very quickly find the money and you will enjoy a day of publicity and the satisfaction of irritating them enormously.
