Unhappy Delta refuses to accept return of sky miles, flt 338 Jan 16, 09

Last November I was booking two FC tickets from GDL to Philadelphia. I bought one over the phone for $1440, the other I tried to get with my Sky Miles balance of approx. 85,000 miles. The telephone agent told me it now cost 100,000 miles. When I asked "since when" her response was that she had been on sick leave and when she returned that is how it was, didn't know when it changed or why (but she added it is better for you now since more seats are available)! So at her suggestion I went online and bought approx 20,000 miles in a package for $438.00. Two days later when they were accredited to my account I called back to buy the mileage ticket. Then I was told I needed only 80,000 miles and $70 something for the fees. I protested and said I would like to return the miles I had bought for no reason..... NO, NO RETURNS!
I have tried American Express (that's how I paid for them) and writing and writing to Delta ... how can they be so cheap!! Are they that desperate for the $400 bucks? Guess so! Anyone know a method to send these miles back? How can any purchase be non-refundable based on flawed information from the seller?

Ask for a tape of your call. I am not sure if the Data Protection laws are the same in the US, but you would be entitled to it..then file in the smalls claims court. This is a case of mispresentation. The vendor, no matter what the product, cannot misrepresent it to you. The contract is not valid. Also, contact the BBB in your area and file a complaint. They will not be able to defend this action, especially if you acted promptly.
