Default Changed my flight without notice

I booked a flight from Charleston, WV to Ft. Lauderdale in January 2012. When I arrived to the airport on May 4th for my flight there was no one working for Spirit even at the airport. I called customer service and was informed I "forfeitted" my flight. Spirit cancelled my flight on May 4th and resceduled for May 3rd. They claim to have sent me an email stating the change, but I nevered received any notice. You have to provide your home phone and address when booking a ticket, but they do not use this information for anything important. I was told I could not get my money back and I could not be compensated with another flight. I will never fly Spirit again and I encourage others to choose a different airline as well.

Search your spam folder for spirit. If you have no email, file a complaint with the State Attorney General's office. Changing your flight to the day before is a substantial change in your itinerary and you did not agree to this, so you should be able to get a refund. I consider Spirit acting unreasonable in not making a reasonable effort to advise you of the change, as they had your phone number etc. A lot will rest on whether it was felt that the email was sufficient effort to notify you. It would also at least require Spirit to provide proof that such an email was sent. You might also consider filing a claim in small claims court, which will also inconvenience Spirit greatly and force them to provide proof if they have it. Airlines often fight these claims right up to the court hearing and then give up and pay up. Small claims is easy and cheap to do, so don't feel intimidated.

I have checked my spam folder and found nothing from Spirit. I called the customer service number again and asked for the proof of the email such as a copy or confirmation and was first told they no longer have the email because it was sent back in February. Then the story changed to "it is against our policy to send you this."

Ask them to send you proof that it is against their policy to prove that they advised you. I believe Spirit are in breach of their contract. I would go to small claims and let them provide the proof. If nothing else, you will cause a small amount of the inconvience they caused you and if you win you will get paid and reimbursed for court costs.
