This is my second time flying with Delta and I'm ready to sue!!
The first time I my flight was delayed 2 hours due to maintenance. They put me in a cab to my connecting flight, but the cab driver got pulled over for a number of things making me late for the next flight. They made me wait standby for the last flight, but it was full so they put me in a hotel. I left out that morning, and that was that. I understand things happen, and that was partly the cab driver's fault so I wasn't too angry. I had a carry on that I used on the way there. It wasn't a problem at my origin or the connecting flight in Atlanta. On the way back they told me my carry on was too big? It wasn't,i put it in the measuring thing...and I was able to get through 2 airports with it. She said because so many people were on the flight I had to check it, so they made me pay the $25 fee on the way back...that ****** me off! Second time even worse. I left Sunday afternoon to get to my destination that night. I was starting my first day of my career the next day. Well the flight was delayed...big surprise...due to weather. Before I left from my origin I called Delta and asked for my money back and said I will find a way to get there myself. The guy on the phone told me I couldn't because it wasn't their fault. They boarded the plane, but they kept pushing our departure time back. We ended up sitting on the plane for 2 hours! They wouldn't let anyone get off either. When I got to my connecting flight in atlanta I missed the flight because of the delay. I checked the policy online again and it said if it's not their fault we can have a refund. So I called back and asked for a refund. The guy wouldn't give it to me because I already left my origin. I don't know the status of my job yet, but if I lose it because some idiot doesn't know the policy...definitely suing. All they had to do was give me my money back. I only used Delta these last 2 times because they were the cheapest. But you know how the old saying goes, you get what you pay for. I should have stuck with US Airways!! as far as the weather, its not their fault and by law they dont have to let you off the aircraft until you are sitting there for 3 hours domestic. (In my opinion, 2 hours is still too long) but they want everybody on board and ready, in case a slot opens up or ATC says..GO. I did read the contract and it does state....
RULE 240: FLIGHT DELAYS/CANCELLATIONS B. Delta’s Liability in the Event of Schedule Changes, Delays and Flight Cancellations In the event of flight cancellation, diversion, delays of greater than 90 minutes, or delays that Delta Domestic General Rules Tariff Page 43 of 51 will cause a passenger to miss connections, Delta will (at passenger’s request) cancel the remaining ticket and refund the unused portion of the ticket and unused ancillary fees in the original form of payment in accordance with Rule 260 of these conditions of carriage. HOWEVER....if you read below that.... Delta shall have no liability if the flight cancellation, diversion or delay was due to force majeure. As used in this rule, “force majeure” means actual, threatened or reported: (1) Weather conditions or acts of God (2) Riots, civil unrest, embargoes, war, hostilities, or unsettled international conditions (3) Strikes, work stoppages, slowdowns, lockout, or any other labor-related dispute (4) Government regulation, demand, directive or requirement (5) Shortages of labor, fuel, or facilities (6) Any other condition beyond Delta’s control or any fact not reasonably foreseen by Delta Last edited by cortney; Jul 2, 2012 at 9:52 AM. I am most upset about not getting a refund when I could have. I called customer service before I got on any flight and was told I could not get a refund. The policy says that I can get a refund, not only did I read this but the guy I got on the phone the second time told me that. My bags are also lost because of the delay. However, all of this could have been avoided if I would have gotten my refund when I asked. I was going to rent a car and just drive myself. I'm sure the calls are monitored and I will take legal action. I may lose my job and not to mention all the items in my bag. The customer service reps at Delta seemed to show no sympathy.
I would copy and paste the policy, but I'm on my phone. If you go to the refund policy on their website, it will tell you that anything not their fault can be refunded. Last edited by KikiSW; Jul 2, 2012 at 10:13 AM. |

And as far as my carry on issue...they have a thing where you can check to see if your bag can be used as a carry on. I did that, and it could be used as a carry on, but because I had a full flight I couldn't take it with me. If they were going to check my bag because of a full flight it should have been free, but I had to pay!

I agree with Kiki...first off, if the bag met the requirements for hand luggage, you should not have to pay. The key to this is when you put the bag in the measuring device, take a photo of the bag with your phone, otherwise the liars at Delta will claim that the bag was over full and didn't fit.
On the issue of the delay, Delta should have refunded this. They are responsible for poor advice. I would complain to the DOT stating that Delta failed to follow their own policy. They will not be responsible for any further liability as a result of their failure to perform, so I would not get too deep into that. Even if you lost your job as a result, Delta have no liability whatsoever. Delta are just about the worst choice of the majors and to avoided at all costs...as you have discovered. |

i agree with the carry on complaint 100%. I just flew delta on the 28th of june from chicago to anchorage with a connection in minneapolis. I actually had a REALLY good experience. both flights were early arriving, outstanding flight crews and checked luggage made it! was impressed. go online to delta.com they have a request a refund part on their webpage. try that.
Jim maybe you know. i dont know much about deltas policies and rarely fly them (only when my company books me on them do i fly them, and i have to ) But do you think she couldnt get a refund because she may have booked a non refundable ticket? Or does delta give you a refund if you decide not to travel (in this persons case) due to weather delays even on a nonrefundable ticket? I looked every where on delta.com and keep finding that no refunds are given if the delay is beyond deltas control
